Panther,

Last night I went to the grand opening of Outdoor World at Patriots Place.

Fabulous.

They had a full display of new Glocks and were selling them telling me the guns were now mass compliant.

Today i went in to buy one and they had been pulled off the shelf, no reason given.

Of course the reason is they are non Mass compliant and they made a big mistake in offering them for sale.

What happens now to the guns in the hands of the owners?

After reading your post, I decided to take a quick look at the Massachusetts firearms license statutes codified at Mass. General Laws chapter 140. I don't own firearms and this has not bee part of my practice, but I figured that licensing statutes ought to be fairly simple and straightforward. Boy, was I wrong. I'm not sure why or how the Glocks you saw for sale were not "Mass. compliant." The licensing statute, at MGL c. 140 sec. 131 outlines the types of firearms that a particular license covers. Because I know nothing of firearms, I don't know what all of the terms mean ie: "large capacity firearms, and feeding devices and ammunition therefor." However, the statute does say in part:

"A violation of a restriction imposed by the licensing authority under the provisions of this paragraph shall be cause for suspension or revocation and shall, unless otherwise provided, be punished by a fine of not less than $1,000 nor more than $10,000; provided, however, that the provisions of section 10 of chapter 269 shall not apply to such violation." (MGL c. 269 sec. 10 is the criminal statute regarding carrying dangerous weapons.)

This language leads me to believe that if you own a firearm not covered by the license, then you are violating the law and your license is subject to revocation. I don't believe it would matter that the violation is unintentional. As a firearm license holder, you are deemed to know what type of firearm the license allows, and whether any particular firearm you own is within the firearms covered by your license.

I warn you again that I am far from an expert in this field, so take this with a grain of salt.

In a separate letter and in a Boston Globe article, the Massachusetts Attorney General's office is "encouraging" and "urging" customers who bought these Glocks to return them.

Only pre-10/21/98 models are legal to sell MA.

Commercial sales of brand new post 10/21/98 Glocks have ceased.

If you left us a deposit on one please stop by the shop for a full refund.
